Key issues with environmental permitting and the Endangered Species Act

Our colleague Mark Sudol was just quoted in Bloomberg on a federal court ruling vacating Florida’s takeover of a federal wetlands dredge-and-fill permitting program. That decision has put renewed focus on the Endangered Species Act and its powerful role in construction permitting. 


Mark headed the US Army Corps of Engineers Regulatory Office prior to joining us and he oversaw the Corps’ response to 2 major Supreme Court decisions on permitting. 


As he told Bloomberg, “Significant delays are going to occur in Florida.” Mark added that the Corps of Engineers is likely to begin taking over permitting in Florida soon and the Corps is likely to be flooded with permits without much time to ramp-up its permit processing operation.
