Getting to “best value” in federal contracting


Our colleague Jimm Rich joined Dawson & Associates in 2016 after 35 years in the U.S. Army Corps of Engineers. Jimm is a prolific writer on federal contracting and contract management and his new article “Achieving Best Value in Source Selection” appears in the June 2023 issue of Contract Management magazine.


Prior to Dawson & Associates, Jimm was Chief of Contracting for the Corps of Engineers’ Baltimore, Kansas City and Galveston districts.

Acquisition rules for both defense and civilian agencies contain a clear preference for holding discussions with offerors during best-value source selections. While neither the Government Accountability Office (GAO) nor the courts have yet required discussions, it is hard to contend the government truly obtains best value without them.


On January 3, 2023, the U.S. Court of Federal Claims (COFC) issued a ruling in SLS Federal Services (SLS) v. The United States that sustained an SLS protest and enjoined the Naval Facilities Engineering Systems Command (NAVFAC) from proceeding with performance of six contracts previously awarded.


Halting execution of a $5 billion indefinite-delivery, indefinite-quantity contract for global construction work awarded in July 2021 makes a powerful statement, but the message the court sent is not new.
